New York’s Diversity CLE Requirement And What It Means For You

New York recently initiated a Diversity, Inclusion and Elimination of Bias (D&I) CLE requirement for experienced attorneys. This new category of CLE credit became mandatory on January 1, 2018 and it follows a resolution in February of 2016 by the ABA recommending states implement the requirement. The D&I requirement had significant support by City Bar President as well as by the New York’s Diversity & Inclusion Office and Committee to Enhance Diversity in the Profession.

Met by an overwhelming House of Delegates approval vote within the State Bar, the D&I will include programs that relate to law practice as well as equal access to justice, implicit and explicit bias, serving diverse populations, diversity initiatives and inclusion initiatives within the practice of law and other programs.

New York MCLE Diversity & Inclusion Program Offerings

MCLE Diversity & Inclusion program offerings will align with the State Bar’s requirement to address sensitivity and cultural Students of CLE courses sitting in on course roomdiversity within the legal sphere. Courses will focus on dealing with differences while interacting with judges, litigants, jurors, lawyers, court personnel and members of the public.

The CLE Board has noted that these D&I programs might include subject matter addressing diversity as well as inclusion and elimination of bias regarding race, national origin, ethnicity, sexual orientation, gender, gender identity, disability, religion and age – among other topics.

What Experienced Attorneys Need to Know

Any experienced attorney who is required to re-register on July 1, 2018 or any time after, has to complete a minimum of 1 credit hour pertaining to D&I. The change in New York MCLE requirements doesn’t increase the current biennial CLE requirement of 24 credit hours for experienced attorneys. It doesn’t change the current requirement for 4 credit hours of courses taken in Ethics and Professionalism either.

Newly admitted attorney biennial requirements for CLE have not changed because of this new mandatory course.
